Honourable Colonial Secretary:-

In regard to Sir H. de Sausmarez's letter sub-

section (a) is in my opinion sufficient without Colonial

legislation.

2. I would suggest that in sub-section (c) the

words "if there is no such ship available then" may be omit-

ted. They are taken from Article 83 (7) of the Order in

Council of 1904 but I think they may possibly supply an argu-

ment for other ships refusing to take persons to be deported

on the ground that one of His Majesty's Ships of war is

"available". In any event I submit that the words are un-

desirable.

3. In sub-section (d) it will be desirable to in-

sert at the end the following words:-

"to be recovered summarily before a Magistrate

in Hongkong".

I presume $500 should be substituted for £50 to meet the

local currency.

A blank is left for the officer who fixes

the reasonable remuneration and Sir H. de Sausmarez drews

attention to it. The matter will not be before a Judge here.

I should think it might be done by the C.S.F. It would of
